Background Information
Misleading Advertising – Scandinavian Log Cabins Direct is in breach of the UK Advertising Standards Code for quoting prices exclusive of VAT.
The ASA published an adjudication against Scandinavian Log Cabins Direct (SLCD) http://www.slcd.co.uk on 3 August 2011 (see below). The ASA investigated whether the website was misleading because the prices provided on it did not include VAT or delivery charges. The ASA concluded that, because VAT needed to be paid by consumers for 36 product lines, the website should have given VAT-inclusive prices. The ASA noted that the website stated "The standard delivery charge for this product is 10% of the order value to anywhere in mainland Britain and 15% to Ireland" but considered that the delivery costs should have been more prominently displayed and closer to the advertised prices. Because they were not, the ASA concluded that the ad breached the Code.
Although the ASA has adjudicated against SLCD, and has made requests for an assurance of future compliance, SLCD continues to feature prices exclusive of VAT on its website www.slcd.co.uk, and the delivery costs are not prominently displayed closer to the advertised prices.
Because of SLCD’s continued non compliance we took the decision to place its details on the ASA section of the website on 3 February.
These details shall remain in place until such time as SLCD has amended the claims on www.slcd.co.uk to ensure compliance with the CAP Code.
