A circular, handed to home vendors, on 25 May 2011, featured a graph entitled "Weekly Sold Report" which illustrated the number of properties sold by 11 estate agents in the Liverpool area from 7 January 2011 to 29 April 2011. The graph showed that Entwistle Green had sold the most properties. A disclaimer in the smallprint at the bottom of the page stated "Information sourced from estate agency Internet data, collated by Vizzihome and published by Countrywide Mi. Due to variations in publishing policies, or where such information is believed to be inaccurate or otherwise manipulated, not all agents and property data may be represented. Whilst every effort is made to ensure the accuracy of the data, no responsibility can be accepted for any errors or omissions. We compile data from portals and individual websites."
Issue
Logic Estates challenged whether the implied claim that Entwistle Green had sold the most properties in the area during the period was misleading and could be substantiated.

Entwistle Green (Entwistle) explained that the sales information used in the circular had been obtained from the Vizzihomes website, a website which sourced information from estate agency internet data, collated it and published it online. Entwistle had carried out a search on the Vizzihomes website on 29 April 2011 to obtain sales information for the relevant period and within a specified postcode area. The results showed that their Crosby office had sold 38 properties during the relevant period in the specified area, whereas Logic in Liverpool had only sold six properties. Entwistle had printed the results of the Vizzihomes search and handed it to two vendors.
Entwistle believed it was reasonable for them to have relied on the information provided by Vizzihome and pointed to the disclaimer in the smallprint of the circular which clarified the veracity of the data.

The ASA considered that the data in the circular implied that Entwistle was the best-selling agent in the specified postcode area in the relevant period. We understood that the data collected by Vizzihome relied on agents advertising all of their properties online and ensuring they were accurately marked online as being sold. We noted the disclaimer in the circular stated "Due to variations in publishing policies or where such information is believed to be inaccurate or otherwise manipulated, not all agents and property data may be represented. Whilst every effort is made to ensure the accuracy of the data, no responsibility can be accepted for any errors or omissions." and noted a similar disclaimer featured on the Vizzihome website. We therefore considered that some estate agents and some properties may not have been counted.
Because the disclaimer in the circular and on the Vizzihome website suggested that the data may not have been accurate, and we had not seen any robust evidence to substantiate the data in the circular, we concluded that the implied claim in the circular that Entwistle's Crosby office had sold the most properties in the area during the relevant period was misleading.
The circular breached CAP Code (Edition 12) rules 3.1 (Misleading advertising), 3.7 (Substantiation), 3.33 and 3.35 (Comparisons with Identifiable Competitors).
Action
The circular must not appear again in its current form. We told Entwistle to ensure they hold adequate substantiation for their objective comparative claims in future.
